By downloading, installing, using, and/or purchasing anything within the Race Against Time app, known as the WIN R.A.T PUZZLE App (“the App”), you engage in our “service” and agree to comply with and be bound by these Terms and Conditions ("Terms"), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. If you do not agree with these Terms, please refrain from using the App.

License:

Grant of License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal entertainment purposes.

In-App Purchases: The App may offer in-app purchases, including real physical toys. By making such purchases, you agree to the applicable payment terms and acknowledge that all purchases are non-refundable.

Restrictions: You may not modify, distribute, transmit, reverse engineer, or attempt to gain unauthorized access to the App. Unauthorized use may result in the termination of your license.

Age requirement: 

You must be 15 years and older to use our app. If you are under 15 years of age, you must have your parent or legal guardian’s permission to use our app.

User conduct: 

You agree not to use our app for any illegal or unauthorized purpose, and you agree to comply with all laws and regulations of Malaysia. You also agree not to harass, bully, or intimidate other users of the app.

User Responsibilities:

You are responsible for ensuring compliance with these terms and any applicable laws while using the app. Any misuse or violation may result in the termination of your account. You are responsible for maintaining the security of your account credentials. Any unauthorized access must be reported immediately.

User content: 

Any content you post in our app, such as usernames, comments, and profiles, must comply with our content guidelines. We reserve the right to remove any content that violates our guidelines.

Intellectual property: 

All intellectual property rights, including trademarks, copyrights, and patents, in our app and its content belong to us or our licensors. You may not reproduce, modify, distribute, or create derivative works based on our app or its content without our express written permission.

Purchases of the game: 

Our app may offer to purchases. By making the purchase, you agree to pay the applicable fee and to abide by the terms and conditions of the app or payment provider.

Information Error, Inaccuracies or Omissions

Indemnification:

You agree to indemnify, defend and hold harmless the company, our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and all employees of the company directly and indirectly, automatically upon payment made to purchase the game and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of our app or any violation of these terms and conditions.

Changes to the terms and conditions:

We reserve the right to change these terms and conditions at any time, and your continued use of our app after any such changes constitutes your acceptance of the new terms and conditions.

We reserve the right to terminate your use of our app at any time and for any reason, without prior notice or liability.

Governing Law:

These terms are governed by the laws of Malaysia. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Malaysia.

Dispute Resolution:

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved through arbitration in accordance with the rules of the suitable Malaysian Arbitration Act, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Severability:

Should any provision within these Terms of Service be found unlawful, void, or unenforceable, said provision shall still be enforceable to the maximum extent allowed by applicable law. The unenforceable portion shall be considered severed from these Terms of Service and this determination shall not impact the validity and enforceability of the remaining provisions.

In-App Purchases:

Acceptance of Terms:

By purchasing toys within our mobile application, you agree to abide by these terms and conditions.

Toy Purchases:

Our application offers a variety of physical toys for purchase within the app. These purchases are made using real-money transactions via our payment gateway (online banking or card or e-wallet payment methods). You own the toy once payment is successfully complete.

Age Restriction:

Users must be of legal age, 15 years and above or have parental consent to make purchases within the app. By making a purchase, you confirm that you meet the necessary age requirements.

Payment:

Payment for the physical toys is processed through the local payment gateway. Users are solely responsible for any charges incurred through these transactions.

Shipping & Delivery:

Details regarding shipping, delivery times, and associated costs for physical toy purchases will be communicated during the purchase process.

Return and Exchange:

All toy purchases are final and non-refundable. We accept returns and exchanges for our physical toys within 14 days from the date of receipt. To be eligible, the item must be unused, in its original packaging, and in the same condition as received. 

To initiate a return and exchange, please contact us at salesmanager@ratwin.app within the specified return period. Provide your order number, a detailed reason for the return and exchange, and clear photos of the product.

The exchange of the initially purchased physical toy for an identical item is subject to availability of stock. In the event that the same item is unavailable, the purchaser retains the right to exchange it for any other toy of corresponding value.

The purchaser is responsible for covering the return shipping costs, except in cases where the return is prompted by a product defect or an error on our part.

Usage Restrictions:

Users may not transfer, sell, or exchange toys obtained within the app for real currency, goods, or services outside the app. Any attempt to do so may result in the suspension or termination of the user's account.

Availability:

We reserve the right to modify, update, or remove physical toys from the app at any time, without prior notice. This includes changes to pricing, availability, or features associated with the toys.
